DSP Cartel – Terms & Conditions

Welcome to DSP Cartel. These Terms & Conditions (“T&C”) govern your use of our website and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by this T&C, along with our Privacy Policy, DMCA Policy, Anti‑Fraud Policy, and any specific terms applicable to particular services you may use.

If you are using DSP Cartel on behalf of an artist, label, company, or any entity — you represent that you have the legal authority to bind that entity to these T&C.


1. Use of Site and Services

  • Age restriction: DSP Cartel is intended for users 18 years or older. Persons between 13 and 18 may use the Services only with verifiable parental or legal guardian consent.

  • Ownership of Site Content: All content on the Site — including software, design, text, graphics, and service‑related content — remains the property of DSP Cartel or its licensors. Your use gives you a limited, non‑exclusive, revocable, non‑transferable license to access the Site and Services under these T&C.

  • Downloads & Purchases: If DSP Cartel offers downloadable content (music, artwork, files), those downloads are licensed for personal, non‑commercial use only (unless a separate license agreement is made). Redistribution, resale, modification, or commercial use is prohibited unless explicitly permitted.

You agree not to use the Site or Services for abusive, unlawful, infringing, or harmful purposes — including but not limited to: infringing intellectual property, spamming, unauthorized data collection, distributing malware or harmful code, or interfering with the Site’s operation.


2. Registration & Account Security

  • Some Services require you to register and create an account (provide username, password, email, and other required info).

  • You are responsible for maintaining the confidentiality of your account credentials and for any activity under your account.

  • Registration data must be accurate, complete, and kept up-to-date.

  • DSP Cartel may refuse or cancel registrations at its discretion.

  • Inactive accounts (e.g. unused for a long period) may be terminated or deleted, at DSP Cartel’s discretion.


3. User-Submitted Content

  • Content that you upload or submit (music, recordings, metadata, artwork, images, text, metadata, etc.) is “User Content.”

  • You retain ownership of User Content — but by submitting it, you grant DSP Cartel a worldwide, royalty-free, transferable license to reproduce, convert, distribute, transmit, publicly perform, display, adapt, excerpt, sublicense, and otherwise use the User Content as necessary to provide Services, including distribution to Digital Service Providers (DSPs), promotion, marketing, or storage.

  • You warrant that you own or have the necessary rights to submit User Content, and that it doesn’t infringe third-party rights. If your content includes material (samples, compositions, recordings, artwork) from others, you are responsible for obtaining all required clearances and paying necessary royalties or fees.

  • DSP Cartel may refuse, remove or disable any User Content, at its sole discretion, without obligation to compensate you. DSP Cartel may also disclose User Content if required by law or to protect rights/safety.


4. Distribution Services (if applicable)

If you use DSP Cartel to distribute recordings to DSPs (streaming platforms, digital stores, download services, etc.), the following apply:

  • You authorize DSP Cartel to reproduce, convert, adapt, distribute, sell, publicly perform, stream, and otherwise exploit your recordings and associated materials.

  • You agree to pay any service or distribution fees as required. DSP Cartel may provide identifiers (e.g. UPC, ISRC) for your releases; such identifiers are for DSP Cartel-service use only and may not be resold or transferred independently.

  • DSP Cartel may change which DSPs it works with; your releases may be added or removed from certain DSPs at DSP Cartel’s discretion.

  • DSP Cartel makes no guarantee that your recordings will achieve any sales, streams, placements, or visibility. Whether a DSP offers your music — or whether users discover/purchase/stream it — is outside our control.

  • Revenue or “sales income” distributed to you will reflect actual receipts minus any applicable fees, charges, or deductions. DSP Cartel may withhold or forfeit income if there is suspicion of fraud or infringement, or if you owe balances under the T&C.


5. Payments, Fees & Refunds

  • Some features of the Services may be free; others may require payment of fees (one-time, recurring, per-release, subscription, or other service fees). You are responsible for all applicable fees, taxes, duties, and other charges.

  • Fee schedules will be listed in your account dashboard or otherwise communicated to you. DSP Cartel may change fee amounts or payment terms at any time and at its discretion.

  • Unless otherwise specified, all purchases are final.


6. Confidentiality

You may become aware of confidential information about DSP Cartel’s business practices, operations, or other proprietary information. You agree to keep such information confidential and not to disclose it unless required by law.


7. Usage Data & Analytics

DSP Cartel may collect usage data — analytics, streams/sales statistics, performance metrics, user interactions, metadata — associated with your content or releases. You may have access to some usage data via your account dashboard.

You agree to handle any usage data responsibly, comply with applicable data-protection laws, and not to resell or share usage data with unauthorized third parties without DSP Cartel’s consent.


8. Termination

  • You may terminate your use of the Site or Services at any time (via your account dashboard or by giving written notice), subject to any outstanding fees or obligations.

  • DSP Cartel may suspend or terminate your account or access to the Services at any time, with or without cause — for non-payment, violation of these T&C, suspected abuse, fraud, or for any other reason.

  • Upon termination, DSP Cartel may delete your User Content, release data, or account information; DSP Cartel is not obligated to maintain backup copies. Some rights granted under these T&C (e.g., licenses granted by you) may survive termination.


9. Disclaimers & Limitation of Liability

  • DSP Cartel and its affiliates provide the Site and Services “as is” and “as available,” without warranty of any kind (explicit or implied), including warranties of merchantability, fitness for a particular purpose, non-infringement or suitability.

  • DSP Cartel does not guarantee any specific result — sales, streams, downloads, audience size, royalties, promotion, or success.

  • DSP Cartel is not responsible for any loss, damage, or harm arising from your use of the Services — including lost profits, data loss, or indirect/consequential damages.

  • In jurisdictions or circumstances where limitation of liability is restricted, such restrictions may not apply — but you agree that to the fullest extent permitted by law, DSP Cartel’s liability is limited as described herein.


10. Governing Law & Dispute Resolution

These T&C are governed by the laws of South Africa. Any disputes arising from or related to these T&C or the Services shall be resolved under the courts or legal processes applicable in South Africa.


11. Updates to the Terms

DSP Cartel reserves the right to modify or update these T&C at any time, at our sole discretion. The updated version will be “effective as of” the date posted. It is your responsibility to check the T&C periodically. Continued use of the Services after posting constitutes your acceptance of the changes.

If you do not agree with updated terms, you must discontinue use of the Services.
