DSP Cartel’s Anti-Fraud Policy

Warning System

DSP Cartel issues up to two warnings to clients before considering account termination. In extreme cases involving significant violations or harm to our business, immediate termination may occur.

Warnings aim to highlight potentially fraudulent or infringing activities and provide clients an opportunity to address and correct the situation. DSP Cartel expects clients to investigate these warnings promptly and take corrective action to prevent repeated violations.

Clients will be notified of any violation within three business days of its discovery or report. Violations include, but are not limited to:

  • Intellectual property or trademark infringements
  • Significant levels of artificial streaming
  • Violations of DSPs’ Terms of Use
  • Breaches of YouTube’s monetization policy

Warning Stages

First Warning:
Issued in cases of recurring violations:

  • Parent-child accounts: When a sub-account repeats a violation within 60 days of the initial report.
  • Non-parent-child accounts: When the same type of violation recurs within 60 days.

Second Warning:
Issued in cases such as:

  • Parent-child accounts: Failure to act on violations or an increasing number of infringing sub-accounts within 60 days.
  • Non-parent-child accounts: Continued repetition of the same violation.

Review for Account Termination:
Upon a second warning, DSP Cartel will work with the client on a remediation plan, including specific goals to prevent further violations. However, DSP Cartel reserves the right to terminate accounts or withdraw DSP access at its sole discretion if fraudulent activities persist.

Consequences of Fraudulent Activities

If a client or their end users breach our terms or DSP agreements, DSP Cartel reserves the right to:

  • Remove content
  • Withhold royalties in escrow
  • Disable DSP distribution for the client or end users
  • Terminate end-user accounts
  • Terminate the client’s account

Fraudulent or infringing activities may lead to account closure, with associated costs (e.g., legal fees) deducted from future payments. Additional legal actions may be taken if damages exceed withheld funds.

Account Unblocking

Blocked accounts will receive a notification outlining the issue. Clients must provide requested information within five working days for verification. If verified, the account will be unblocked. Required steps may include:

  • Correcting account information
  • Providing identification (passport or ID)
  • Sharing artist profiles, website URLs, and social media accounts to verify legitimacy

Blocked Account Policy

Clients who fail to provide requested information within five days will have their accounts blocked. Blocked accounts lose platform access, and all content will be taken down. Royalties will be held in escrow for 24 months, as DSPs reserve the right to reclaim funds during this period.

Withholding Royalties in Escrow

Revenues from flagged accounts will be held in escrow for up to 24 months. This ensures DSP Cartel can respond to:

  • Proving an account is not fraudulent, releasing royalties to the rightful party
  • DSPs requesting refunds for unauthorized activity
  • Legitimate rights holders claiming withheld royalties
